Arrest at a third party's home
451 U.S. 204 (1981)
Quick Rule
An arrest warrant for a suspect does not by itself authorize searching a third party's home for that suspect. Generally obtain a search warrant unless valid consent or exigent circumstances apply.
Field Reminder
Determine whose residence it is before relying on the arrest warrant.
Important Limits
Believing the suspect is visiting does not eliminate the resident's Fourth Amendment protection. Any consent or emergency basis must be independently supported.
