Answer genuine questions about rights
737 So. 2d 520 (Fla. 1999)
Quick Rule
When a suspect asks a clear, genuine question about a constitutional right during interrogation, stop and make a good-faith effort to answer before resuming.
Field Reminder
Give a straightforward answer; do not evade a question about the value of having an attorney.
Important Limits
A question about rights is different from an ambiguous invocation after a valid waiver. This ruling does not require clarification of every ambiguous comment.
