Custody plus interrogation
384 U.S. 436 (1966)
Quick Rule
Before custodial interrogation, provide the required warnings and obtain a valid waiver. Custody and interrogation must both be present for the Miranda warning requirement.
Field Reminder
Use the agency-approved warning card. If the person invokes silence or counsel, stop interrogation and follow the applicable invocation rules.
Important Limits
Silence and counsel invocations have different rules. After a counsel invocation, police generally may not reinitiate custodial interrogation without counsel (Edwards); do not assume repeating warnings permits restarting. Volunteered statements differ from interrogation.
