Vehicle search incident to arrest
556 U.S. 332 (2009)
Quick Rule
A recent occupant's arrest permits a passenger-compartment search only if the arrestee can reach it at the time, or there is reason to believe it contains evidence of the arrest offense.
Field Reminder
Document which Gant ground applies; arrest alone does not authorize a vehicle search.
Important Limits
This rule does not automatically authorize a trunk search. Other grounds, such as automobile-exception probable cause, must be independently established.
