Cell-phone searches
573 U.S. 373 (2014)
Quick Rule
Arrest alone generally does not authorize searching a phone's digital contents. Obtain a search warrant unless a separate exception applies.
Field Reminder
Securing the phone and searching its data are separate actions.
Important Limits
A genuine emergency may justify a warrantless search based on the particular facts. There is no automatic emergency exception for every seized phone.
