Stop vs. frisk
392 U.S. 1 (1968)
Quick Rule
An investigative stop requires specific facts supporting reasonable suspicion of criminal activity. A frisk requires a separate reasonable suspicion that the person is armed and dangerous.
Field Reminder
Document the facts supporting each. Keep the frisk limited to locating weapons.
Important Limits
A hunch is insufficient. A weapons frisk is not a general evidence search; keep the stop and frisk reasonably limited to their purposes.
