Aggressive careless driving
Florida Statute § 316.1923
Aggressive careless driving is defined as two or more listed acts committed simultaneously or in succession: the specified speeding, unsafe lane change, following too closely, specified failure to yield, improper passing, or traffic-control/signal violation. Identify each act and its own statutory requirements, and document their sequence. This section supplies a definition rather than a standalone fine schedule; cite the supported underlying violations. It does not automatically establish reckless driving's willful-or-wanton mental state.
Careless driving
Florida Statute § 316.1925(1)
A driver on streets or highways must act carefully and prudently for the road's width, grade, curves, corners, traffic, and other circumstances so as not to endanger people or property. Describe the driving act and the particular circumstances that made it unsafe; do not rely solely on a conclusory label or the fact that a crash occurred. Ordinary carelessness is distinct from reckless driving, which requires willful or wanton disregard.
Improper backing
Florida Statute § 316.1985
Backing is allowed only when it can be done safely and without interfering with other traffic. Backing on the roadway or shoulder of a limited-access facility is separately prohibited. Document the location, path, visibility, and conflicting traffic or hazard. Outside a limited-access facility, reversing alone is not the violation; identify the unsafe movement or interference.
Reckless driving
Florida Statute § 316.192
Reckless driving requires driving with willful or wanton disregard for the safety of people or property, not merely ordinary carelessness. Document the driving pattern and circumstances showing that level of disregard. Fleeing an officer in a motor vehicle is reckless driving per se under this section. Identify any damage to another's property/person or serious bodily injury caused by the operation because those facts create separate enhanced tracks. Prior convictions change the baseline statutory punishment; consult the detailed guide for the applicable track.
