Motorcycle — handlebars above operator shoulders
Florida Statute § 316.2095(2)-(3)
Summary verified against the 2026 Florida Statutes: October 7, 2026.
Quick Summary
A person may not operate a motorcycle with handlebars or handgrips higher than the top of that person’s shoulders while properly seated. Establish operation AND the actual handlebar/handgrip height relative to the properly seated operator; appearance, an “ape hanger” description, or a measurement taken without the operator does not itself establish the statutory comparison. Document posture and the comparison clearly. This is a civil nonmoving equipment infraction under subsection (3). Passenger footrests are addressed separately in subsection (1), and helmet or eye-protection requirements are separate statutory tracks.
