No proof of insurance/security
Florida Statute § 316.646(3)
Summary verified against the 2026 Florida Statutes: October 21, 2026.
Quick Summary
A person operating a vehicle for which required liability/PIP security applies must carry and display proper proof on demand; paper and authorized electronic proof are accepted. Document whether the driver is the owner/registrant because failure to establish coverage at the time can affect that person's license and registration. Knowingly presenting proof of insurance that is not in force is a separate criminal offense, not this ordinary civil failure-to-display track. Showing an insurance screen does not consent to searching other phone content.

Required Facts & Insurance Guidance
Civil • nonmoving traffic infraction
- The person operated a vehicle subject to the security requirements identified in §316.646(1); AND
- Failed to possess proper proof while operating OR failed to display proper proof on lawful demand under (2).
- Determine owner/registrant status: (3)(a) applies to an owner/registrant; (3)(b) applies to another operator.
Paper or authorized electronic proof is accepted. Displaying a phone screen does not consent to examining other phone content. For an owner/registrant convicted without furnishing proof by the court date that coverage existed at the violation, (3)(a) directs license/registration suspension. That consequence is distinct from proving a criminal coverage offense.
Chapter 318 nonmoving penalty: $30 base, plus applicable assessments. Section 318.18(2)(b)3 permits clerk dismissal with up to a $10 dismissal fee on qualifying proof valid at the time; subsequent purchase alone does not establish prior coverage.

Security / financial responsibility: the qualifying ability to respond in damages; an insurance card is evidence of security, not the security itself. PDL means property damage liability; PIP means personal injury protection. Their statutory requirements are distinct. Owner/registrant vs. other operator: identify the person’s actual role; the civil proof provision has different suspension consequences for these groups. In force: assess actual coverage at the event time, including effective cancellation/reinstatement and any applicable operator policy or authorized alternative.
