School zone speeding
Florida Statute § 316.1895(10)
Summary verified against the 2026 Florida Statutes: October 7, 2026.
Quick Summary
School-zone unlawful speed is cited under 316.1895(10): driving a vehicle within a designated school zone above the lawfully posted speed in force. Subsections (5), (6) and (7) govern active arrival/departure periods, posted times or beacons, and portable signs. Record speed, operative limit, zone location, date/time, signs, school schedule and measurement foundation. The reduced limit is not automatically active all day. Officer citations use 318.18(3)(b)/(c), including a $50 school-zone fine for 1–5 mph over. Camera enforcement under 316.1896 uses a separate more-than-10-mph threshold, $100 penalty and no points. Section 318.19(5) does not list 316.1895; do not presume a mandatory 30-mph-over hearing solely for this subsection. Crash consequences and separate criminal speed offenses require their own facts.

(10) · Violation to cite
Required together: the person drove a vehicle on a roadway designated as a school zone AND exceeded the school-zone speed lawfully posted and in force under this section. Cite §316.1895(10) for this school-zone violation. It is a civil moving infraction under chapter 318; subsections (5)–(7) supply supporting timing/posting requirements rather than separate speeding charges.
Document: driver/vehicle, location inside the zone, measured speed, operative limit, date/time, signs, beacon status or posted hours, and the applicable school schedule. Preserve speed-measurement foundation under §§316.1905/316.1906, including required training, device checks and clear vehicle identification.
Official §316.1895 ↗(5), (6), (7) · Is the reduced limit active?
- (5) Timing/limit: only during the statutory arrival/departure periods, including the 30-minute margins, for a regularly scheduled breakfast program or school session. The reduced limit is not automatically active throughout the school day. Generally no lower than 15 mph unless locally regulated; no higher than 20 mph in an urbanized area.
- (6) Permanent signs: posted enforcement times OR flashing beacons as the alternative. Record the applicable method. “Speeding Fines Doubled” signs are required for zones newly established or re-signed beginning July 1, 2008.
- (7) Portable signs: erected only during pupil arrival/departure hours for regularly scheduled sessions; verify the actual sign and schedule.
If the reduced limit is inactive, evaluate the ordinary posted limit and appropriate general-speed provision. A school nearby does not make the reduced limit enforceable all day. A posting defect needs review; this guide does not declare every defect an automatic dismissal.
Officer-issued citation · penalties and hearing
§318.18(3)(c): 1–5 mph over in a legally posted school zone carries a $50 fine rather than the ordinary warning. Higher school-zone speeds use double the §318.18(3)(b) schedule: 6–9 over $50; 10–14 $200; 15–19 $300; 20–29 $350; 30+ $500. These are statutory schedule amounts, not all-inclusive totals; applicable hearing/sentencing provisions, history and costs may change the result.
Court: §318.19(5) lists §§316.183(2), 316.187 and 316.189 for the 30-mph-over mandatory hearing; it does not list §316.1895. Do not automatically mark a citation solely under (10) mandatory court on that basis. Death/serious-bodily-injury crashes and other independently applicable tracks require separate assessment; follow applicable court procedure.
Camera enforcement · separate §316.1896 process
The camera threshold is more than 10 mph over, not 10 or more. §316.1896(1)(a), (b), (d) covers the specified breakfast/start/end windows under §316.1895; (1)(c) covers the ordinary posted limit under §316.183 during the school session. This does not extend the reduced limit throughout the day or create a 10-mph allowance for a deputy-issued citation.
Qualifying traffic-infraction-enforcement-officer cases use the $100 penalty under §318.18(3)(d), with no points or insurance-rate use under §322.27(3)(d)5.c. Camera notices, affidavits, challenges and later citations follow §316.1896; they are not the ordinary roadside fine/points process. Preserve an officer-issued citation’s serial number for the duplicate-camera exception in (7)(b)/(8)(b).
Other provisions · supporting rules, not extra charges
§316.1895(1), (3), (4) concern uniform devices, maintenance and inspection; useful when zone validity is disputed. (2), (8), (9) concern specified installation, crossing controls and safety-patrol visibility, not additional speeding elements. Evaluate §316.1922 separately for 50+ mph over or 100+ mph with its additional threat/interference elements; school-zone speeding alone remains civil.

- 3 at 15 mph or less over; 4 above 15 mph; 6 if resulting in crash; qualifying school-camera enforcement carries no points

Base fines are not the total payable amount. Costs, enforcement method, crash consequences, prior history, and court disposition can change penalties or points. A reported zero does not rule out license suspension or revocation.
