5 offenses
Bicycle improper roadway position
Florida Statute § 316.2065(5)
A bicyclist traveling below normal traffic speed must use the bicycle lane or, if none, stay as far right as practicable. Exceptions permit passing, preparing a left turn, or avoiding hazards/conflicts—including a lane too narrow for a bicycle and vehicle to travel safely side by side. On a one-way road with at least two marked lanes, riding near the left edge is allowed. Record lane width, speed, hazards, and purpose; a rider away from the curb is not automatically in violation.
Bicycle lighting violation at night
Florida Statute § 316.2065(7)
Between sunset and sunrise, a bicycle needs a front white lamp visible from at least 500 feet and both a rear red lamp and red reflector, each visible from 600 feet. Extra lighting does not replace the required devices. Document time, equipment, and visibility. An officer may warn or cite, and the court must dismiss a first charge on proof of purchase and installation of proper lighting; this is ordinarily a pedestrian-penalty violation.
Bicycle traffic-law violation
Florida Statute § 316.2065
Bicyclists generally have vehicle-driver rights and duties, plus bicycle-specific rules. Identify the actual act: improper passenger capacity/child carrier, a rider or passenger under 16 without a compliant helmet, attaching to a vehicle, unsafe two-abreast travel, failure to yield/warn pedestrians on a sidewalk, or inadequate brakes are distinct provisions. Roadway positioning and nighttime lights have separate entries. Record age, equipment, location, and relevant exceptions; bicycle violations generally use pedestrian penalties, and helmet/child-related citation authority has location limits.
Electric bicycle violation
Florida Statute § 316.20655
A qualifying electric bicycle has fully operable pedals, a seat/saddle, a motor less than 750 W and a qualifying assist class: Class 1 pedal assist to 20 mph, Class 2 throttle assist to 20 mph, or Class 3 pedal assist to 28 mph. It shares bicycle duties without driver-license, title, registration or motor-vehicle financial-responsibility requirements. Local access, age and ID rules may differ. Manufacturer/distributor labeling duties are not automatically rider offenses; qualifying modifications require replacement labeling, which cannot legalize a nonqualifying machine. Check bicycle helmets, lighting, brakes and motor disengagement. No pedals or 750 W and above excludes an e-bike but does not alone resolve every other device classification. Identify the exact violation.
Motorized scooter/micromobility violation
Florida Statute § 316.2128
Motorized scooters and micromobility devices generally follow bicycle rules, except provisions that cannot apply to their seating/child-carrier design. Local ordinances may regulate where they operate and impose age or government-photo-ID requirements. These devices do not require a driver license, motor-vehicle registration, or insurance under the cited exemptions. Identify the actual bicycle-rule or valid local-rule violation and device class; do not cite ordinary unlicensed driving solely because a scooter has a motor. Miniature motorcycles have distinct restrictions.
